§ 1 GENERAL PROVISIONS

The www.tinigadgets.com store operates according to the rules specified in these Regulations. The Regulations define the terms and conditions for concluding and terminating Sales Contracts of the Product, the procedure for handling complaints, as well as the types and scope of electronic services provided by the www.tinigadgets.com store, the principles of providing these services, and the conditions for concluding and terminating contracts for the provision of electronic services. Each Service Recipient, from the moment of taking actions aimed at using the Electronic Services of the www.tinigadgets.com store, is obliged to comply with the provisions of these Regulations. In matters not regulated in these Regulations, the provisions of:

  • the Act on the provision of electronic services of July 18, 2002,

  • the Act on consumer rights of May 30, 2014,

  • the Act on out-of-court resolution of consumer disputes of September 23, 2016,

  • the Civil Code of April 23, 1964, and other relevant provisions of Polish law apply.

§ 2 DEFINITIONS INCLUDED IN THE REGULATIONS

ORDER FORM - a form available on the website www.tinigadgets.com enabling the submission of an Order. CLIENT - Service Recipient who intends to conclude or has concluded a Sales Agreement with the Seller. CONSUMER - a natural person who performs a legal transaction with an entrepreneur not directly related to its business or professional activity. ENTREPRENEUR - a natural person, legal person, and organizational unit not being a legal person, which the law grants legal capacity, conducting business or professional activity in their own name. PRODUCT - movable item available in the Store, which is the subject of a Sales Agreement between the Client and the Seller. REGULATIONS - these store regulations. STORE - online store of the Service Provider operating at www.tini-gadets.pl. SELLER, SERVICE PROVIDER - tinigadgets. SALES AGREEMENT - Sales Agreement for the Product concluded between the Client and the Seller through the Store. ORDER - Client's declaration of intent constituting an offer to conclude a Sales Agreement for the Product with the Seller. PRICE - the value expressed in monetary units that the Client is obliged to pay to the Seller for the Product.

§ 3 PRODUCT INFORMATION AND ORDERING

The www.tinigadgets.com store conducts the sale of Products via the Internet. Products offered in the Store are new, in accordance with the contract, and have been legally introduced to the Polish market. Information on the Store's website does not constitute an offer within the meaning of the law. By placing an Order, the Client makes an offer to purchase a specific Product on the terms specified in its description. The Product Price displayed on the Store's website is in Polish zlotys (PLN) and includes all components. The Price does not include delivery costs. Orders can be placed via the website using the Order Form (www.tinigadgets.com) - 24 hours a day, all year round. The condition for placing an Order in the Store by the Client is to read the Regulations and accept its provisions at the time of placing the Order.

§ 4 CONCLUSION OF THE SALES AGREEMENT

To conclude a Sales Agreement, it is necessary for the Client to submit an Order in advance, using the method provided by the Seller, in accordance with § 3 points 5 and 6 of the Regulations. After placing the Order, the Seller promptly confirms its receipt. Confirmation of receipt of the Order, as referred to in point 2 of this paragraph, binds the Client with their Order. Confirmation of receipt of the Order is sent via email. Confirmation of receipt of the Order includes: confirmation of all essential elements of the Order, a withdrawal form, these Regulations containing information on the right to withdraw from the contract. Upon receipt of the email by the Client, as referred to in point 4 of this paragraph, a Sales Agreement is concluded between the Client and the Seller. Each Sales Agreement will be confirmed by a proof of purchase, which will be attached to the Product.

§ 5 METHODS OF PAYMENT

The Seller provides the following payment methods: payment by traditional bank transfer to the Seller's bank account, payment via an electronic payment system. In the case of payment by traditional bank transfer, payments should be made to the bank account number: NL24REVO3046187769 (Bank Revolut). The transfer title should include "Order No....". In the case of payment via an electronic payment system, the Client makes the payment before the Order is processed. The electronic payment system allows payment by credit card or quick transfer from selected Polish banks. The Client is obliged to make the payment for the Price under the Sales Agreement within 7 working days. The Product will be shipped only after payment has been made.

§ 6 COST, TERMS, AND METHODS OF PRODUCT DELIVERY

The costs of Product delivery, covered by the Client, are determined during the Order placement process. The delivery time of the Product consists of the time to complete the Product and the time for the carrier to deliver the Product: the time to complete the Products ranges from 5 to 14 working days (depending on the country of shipment, Poland, China), delivery of movable goods by the carrier takes place within the period declared by them, i.e., 14 working days from the date of dispatch (delivery takes place only on working days, excluding Saturdays, Sundays, and holidays). Products purchased in the Store are shipped only within Poland through Poczta Polska or a courier company.

§ 7 Shipping Regulations from China:

Subject of the Regulations: 1.1. This regulation concerns the process of shipping goods from China by the company TiNi Gadgets (hereinafter referred to as "Aliexpress and Alibaba") to the Client. Nature of Shipping: 2.1. The company operates in a dropshipping model, meaning it acts as an intermediary between the Client and service providers in China. 2.2. Therefore, the Company is not directly involved in the process of shipping goods. Company's Responsibility: 3.1. The Company is not liable for damages, loss, delays, or other problems related to the transport of shipments from China to the Client. 3.2. The Company is not responsible for the quality of courier services or the actions of Chinese suppliers. 3.3. The Company is not responsible for any customs duties, taxes, or other fees that may be levied by customs authorities or other institutions in the destination country. Customer Responsibilities: 4.1. The Customer undertakes to understand and accept that the Company acts solely as an intermediary in the shipping process from China. 4.2. The Customer bears all risks associated with the transportation of goods, including the risk of damage or loss of shipments. 4.3. In case of any transportation-related issues, the Customer agrees to contact the Company's customer service for assistance. Changes to the Regulations: 5.1. The Company reserves the right to make changes to these regulations at any time. 5.2. Changes to the regulations will be binding for Customers from the moment of their publication on the Company's website. Acceptance of the Regulations: 6.1. Using the services of the Company and ordering goods from China implies acceptance of these regulations by the Customer. 6.2. If the regulations are not accepted, the Customer should refrain from using the Company's services. § 8 PRODUCT COMPLAINT

Complaint due to non-conformity of the Product with the contract. The basis and scope of the Seller's liability towards the Customer who is a Consumer due to the non-conformity of the Product with the contract are specified in the Act on consumer rights of May 30, 2014, the basis and scope of the Seller's liability towards the Customer who is an Entrepreneur, due to warranty, are specified in the Civil Code of April 23, 1964, The Seller is liable to the Customer who is a Consumer for the non-conformity of the Product with the contract existing at the time of delivery of the Product and revealed within 2 years from that moment, unless the shelf life of the Product specified by the Seller or persons acting on its behalf is longer, notifications of non-conformity of the Product with the contract and submission of the appropriate request can be made via email to: tini_gadets@wp.pl in the above message, in written or electronic form, please provide as much information and circumstances regarding the subject of the complaint, in particular, the type and date of occurrence of irregularities and contact details. The provided information will significantly facilitate and expedite the consideration of the complaint by the Seller, for the assessment of irregularities and non-conformity of the Product with the contract, the Consumer is obliged to make the Product available to the Seller, and the Seller is obliged to collect it at its own expense, The Seller will respond to the Customer's request promptly, no later than within 14 days from the moment of purchasing the goods, in the case of a complaint from a Customer who is a Consumer - failure to consider the complaint within 14 days from its submission is tantamount to its acceptance, in connection with a justified complaint from a Customer who is a Consumer, the Seller shall, respectively: cover the costs of repair or replacement and re-delivery of the Product to the Customer, reduce the Price of the Product (the reduced Price must be proportionate to the price of the compliant goods to the non-compliant goods) and refund the Consumer the value of the reduced Price no later than within 14 days from receiving the statement of the reduced Price from the Consumer,
